Ukraine establishes system for recording non-property damages caused by the war
On November 20, 2024, the Ukrainian Parliament adopted Law No. 10256 on "Accounting Information on Harm Caused to the Personal Non-Property Rights of Individuals as a Result of the Armed Aggression of the Russian Federation Against Ukraine."
The Law establishes the creation of a System for recording information on harm caused to the personal non-property rights of individuals due to Russia's aggression. This system will compile information about:
- Victims whose personal non-property rights have been harmed, including cases of:
- Death;
- Disappearance;
- Children left without parental care;
- Injury or health damage;
- Sexual violence related to the conflict;
- Torture, imprisonment, captivity;
- Human trafficking, forced labor;
- Forced displacement, deportation, kidnapping, evacuation;
- Loss of access to medical, social, or educational services.
- Harm caused and the measures taken to support the victims, including government and local budget expenditures aimed at providing support.
The Ministry of Social Policy will be the administrator of the information system, which will automatically collect data through electronic interaction with public registries, systems, and databases managed by government authorities. It will also include information provided by the affected individuals or their legal representatives.
The system will serve several purposes, including:
- Providing victims with information about the harm they have suffered.
- Consolidating information from other public electronic registers to assist in protecting their rights and interests.
- Identifying necessary forms of support for victims and the specifics of its provision.
Additionally, a separate Register will be created for information regarding children deported or forcibly displaced due to the war, with the Ministry of Justice as the custodian.
