The President Signed the Law Terminating the Special Regime for Intellectual Property Protection During Martial Law

The President of Ukraine has signed the Law of Ukraine “On the Repeal of the Law of Ukraine ‘On the Protection of Interests of Persons in the Field of Intellectual Property During Martial Law Introduced Due to the Armed Aggression of the Russian Federation Against Ukraine’” No. 43620-IX dated April 16, 2025 (Draft Law No. 9383), with the Committee on Economic Development designated as the lead committee for its review.

The Law provides for the following:

  1. The suspension of deadlines for actions related to the protection of intellectual property rights, as well as for procedures related to the acquisition of such rights, as established by the repealed Law, is terminated.
  2. Annual fees for maintaining the validity of intellectual property rights, as stipulated by the Laws of Ukraine “On the Protection of Rights to Inventions and Utility Models” (including annual fees for maintaining the validity of supplementary protection certificates), “On the Protection of Rights to Industrial Designs,” and “On the Protection of Rights to Plant Varieties,” which became due during the period of effect of the repealed Law and were not paid before the new Law came into force, shall be considered paid on time if paid within seventy-five (75) days from the date of entry into force of the new Law.
  3. The fee for renewing a certificate of trademark registration in Ukraine, as stipulated by the Law of Ukraine “On the Protection of Rights to Marks for Goods and Services,” which became due during the period of effect of the repealed Law and was not paid before the new Law entered into force, shall also be considered paid on time if paid within seventy-five (75) days from the date the new Law becomes effective.
