The anti-mobbing law entered into force

On the 11th of December the Law No. 2759-IX "On Amendments to Certain Legislative Acts of Ukraine on Prevention and Counteraction of Mobbing (Bullying)" entered into force.

By definition, mobbing, or harassment, is a systematic (repeated) long-term deliberate action or inaction of an employer, individual employees or a group of employees of a staff, which are aimed at humiliating the honor and dignity of an employee, his business reputation, including for the purpose of acquiring, changing or termination of his labor rights and duties manifested in the form of psychological and/or economic pressure, in particular with the use of electronic communications, creation of a tense, hostile, offensive atmosphere for the employee, including one that forces him to underestimate his professional suitability.

Forms of psychological and economic pressure include any hostile or offensive behavior in the staff, unjustified isolation, unequal opportunities for career growth and pay, unjustified deprivation of part of the benefits and uneven distribution of workload.

Carrying out any of the listed actions in the workplace is now classified as mobbing and is prohibited by law.

Victims of harassment have the right to file a complaint or go to court. Under the conditions of proving the fact of discrimination and mobbing at the workplace, the employee can be compensated for moral damage if the harassment has led to moral suffering, loss of normal life relationships and requires additional efforts from the victim to organize his life.
