Resumption of Enforcement Proceedings, Removal from the Register and Debt Repayment: Ministry of Justice Updates the Rules
Enforcement proceedings involve not only the performance of enforcement actions but also the proper maintenance of records concerning proceedings, debtors and recovery outcomes. This is particularly relevant when enforcement proceedings are resumed following the return of an enforcement document. The relevant procedures have been clarified by Ministry of Justice Order No. 1998/5 dated 29 July 2026, which amends the rules governing the Automated Enforcement Proceedings System (ASVP), the Unified Register of Debtors, records management, archiving and reporting.
In particular, the Order establishes the procedure for processing applications to resume enforcement proceedings, including their automated allocation. Upon resumption, no new enforcement proceeding is opened; instead, the original unique reference number and the corresponding enforcement history are retained. The Order also clarifies the time limits for automated monitoring of the adoption of procedural decisions and establishes the procedure for retrieving case materials from the electronic archive to resume proceedings.
The grounds for entering information about debtors in the Unified Register of Debtors and removing such information have also been specified. These include particular rules applicable to debtor banks, outstanding alimony payments and the enforcement of non-monetary judgments. In addition, the ASVP will generate notifications confirming debt repayment in enforcement proceedings where the amount to be recovered does not exceed ten minimum monthly wages. Such notification serves as a basis for lifting the seizure of funds, electronic money and securities in electronic form.
