New Rules for Determining Critical Enterprises: Ministry of Foreign Affairs Updates the Criteria

On 30 June 2026, the Ministry of Foreign Affairs of Ukraine issued Order No. 344, which entered into force on 3 July 2026, approving new Criteria for determining whether enterprises, institutions, and organisations under the management of the Ministry qualify as being of significant importance to the national economy in the field of foreign relations during a special period.

The Order was adopted pursuant to the Law of Ukraine "On Mobilisation Preparation and Mobilisation" and replaces the previous Order of the Ministry of Foreign Affairs No. 561 dated 26 December 2024.

The new Criteria establish an exhaustive list of requirements that enterprises, institutions, and organisations within the scope of the Ministry of Foreign Affairs must satisfy in order to obtain Critical Enterprise status. The updated framework is intended to ensure the uninterrupted performance of functions in the field of foreign relations, safeguard Ukraine's foreign policy interests, and provide the legal basis for reserving military-liable employees from mobilisation during the mobilisation period.
