Freelance Law: What Does It Mean?

12/08/2022

On the 10th of August the Law "On Amendments to Certain Legislative Acts of Ukraine regarding the Regulation of Labour Relations with Non-Fixed Working Hours" entered into force. The media called this Law the Freelance Law.

The main innovation of the Law is a new article in the Code of Labour Laws of Ukraine, namely 21-1. It foresees the introduction of a new type of employment contract - a contract with non-fixed working hours.

The main feature of this innovation is the absence of a specific duration of working hours. The duration is determined only by the volume of work. And in the absence of such work, the employee may not work at all.

Additionally, the Law regulates the number of such contracts (one employer cannot have more than 10% of such contracts). However, if the employer employs less than 10 workers, then the Law allows to have only 1 worker under such conditions.
