Enforcement Proceedings Enter a New Era of Digitalisation: Key Changes Effective 23 October
The Association of Private Enforcement Officers of Ukraine has provided an overview of the key amendments introduced by Law No. 4833-IX. Most of the Law’s provisions will enter into force on 23 October 2026 and provide for the digitalisation of certain enforcement procedures, as well as improvements to the mechanisms for enforcing court judgments and decisions issued by other authorities.
One of the key changes will be the automatic lifting of account freezes once the debt has been repaid in full. The Automated Enforcement Proceedings System (ASVP) will automatically generate and send notifications confirming the unblocking of accounts and the removal of the relevant individual from the Unified Register of Debtors.
The amendments will also cover digital financial instruments. Enforcement measures may be applied to electronic money and electronic wallets, as well as funds held in accounts with fintech services and neobanks.
For individuals whose details have been entered in the Unified Register of Debtors, the rules governing deposits will change. Banks will no longer be permitted to extend the term of such deposits, and the funds held in them will be directed towards repayment of the outstanding obligations.
The principle of a single enforcement proceeding will also be introduced. Where necessary, a completed proceeding may be resumed upon application rather than initiating a new one. This is intended to prevent duplicate account freezes and repeated entries in the Unified Register of Debtors.
The amendments also provide for electronic interaction between the ASVP, banks and other authorities through digital channels, enabling debtors’ assets to be identified more efficiently.
At the same time, additional social safeguards for debtors will be introduced: the debt threshold below which enforcement against a debtor’s sole residential property is prohibited will be increased by almost twofold.
