Changes in notary services in Ukraine effective from November 16, 2024
As of November 16, 2024, the Ministry of Justice of Ukraine has implemented new regulations for additional legal services provided by state notaries. The Ministry's Order No. 3081/5, issued on October 29, 2024, updates the procedures for providing legal and technical services that are not related to notarized actions.
Key changes include:
- Updated Procedure: The new order refines the procedure for state notaries to provide additional legal services that are not linked to notarial acts, as well as technical services (originally set out in Order No. 5441/5 of December 6, 2022).
- Updated Fee Structure: The fees for these additional legal and technical services have been revised. The fee structure is now standardized across all state notarial offices in Ukraine.
Notary services will now follow a clear process:
- Pre-Service Explanation: Before providing additional services, the state notary must explain the scope, procedure, and conditions of payment for these services.
- Payment Confirmation: Proof of payment for additional services must be provided in the form of a payment document (receipt, payment order, etc.) marked with the bank or payment service provider’s confirmation of payment completion.
The new regulations ensure that the costs for these additional services are unified across all notarial offices in Ukraine.
