Changes in audiovisual advertising

On May 30th, the Verkhovna Rada adopted the Law "On Amendments to the Law of Ukraine on Advertising" regarding the implementation of European legislation norms into the national legislation of Ukraine. This law provides for the implementation of specific provisions of the EU acquis in the field of audiovisual advertising and certain other laws.

The draft law prohibits any advertising by residents of the aggressor country, as well as the inclusion of discriminatory statements or images inciting hatred, hostility, or cruelty in advertising.

Additionally, outdated provisions will be repealed and requirements for advertising services provided through electronic communications will be simplified. Furthermore, the ban on tobacco advertising, electronic smoking devices, and liquids for such devices will be maintained.

The following changes are planned to be introduced to the Law on Advertising:

  1. Establish clear criteria for identifying advertising falling under the jurisdiction of Ukraine.
  2. Clarify the requirements for the presence of necessary licenses and permits for advertised goods and services.
  3. Improve the regulation of social advertising, including allowing the display of weapons and references to the advertiser if it is a state authority or international organization.
  4. Simplify the rules for interrupting the broadcasting of films, news programs, and children's programs with advertising.
  5. Increase the advertising quota in audiovisual media to 20%.
