CCU Decision on Guaranteeing the Protection of Individual Rights and Freedoms Based on ECHR Rulings: A Draft Law Adopted
The draft law proposes amendments to Part 3 of Article 321 of the Commercial Procedure Code of Ukraine, allowing for the extension of deadlines for reviewing court decisions under exceptional circumstances related to a European Court of Human Rights (ECHR) ruling that has become final, even after ten years have passed since the court decision became legally binding.
Similar amendments are proposed for Part 3 of Article 424 of the Civil Procedure Code of Ukraine and Part 3 of Article 363 of the Administrative Procedure Code of Ukraine.
According to members of the Legal Policy Committee, adopting and implementing this draft law will help uphold the right guaranteed by Part 4 of Article 55 of the Constitution of Ukraine to review court decisions under exceptional circumstances in connection with an ECHR ruling.
