Can an Employee with an On-Demand Work Schedule Hold Another Job? – Official Clarification
An employee has the right to realize their ability to work by entering into an employment contract with one or simultaneously with multiple enterprises, institutions, or organizations, unless otherwise specified by law, a collective agreement, or a mutual agreement between the parties.
According to Article 21-1 of the Labour Code of Ukraine, an employer cannot prohibit or hinder an employee working under a non-fixed (on-demand) working hours contract from performing work under other employment contracts.
Therefore, as clarified by the relevant authority, an employment contract with a non-fixed working schedule may not include any provision that restricts the employee from working under other employment contracts.
